Payroll Tax Problems

The IRS is very hard on employers who do not pay their payroll taxes. Payroll tax returns have penalties that are much more severe than other penalties. The penalties range from 2%, for deposits made 1 to 5 day late, to 15% of amount unpaid 10 days after first IRS notice.

The IRS has gone as far as to criminally prosecute the individuals that are responsible for paying the payroll taxes, and the IRS has been successful. In United States v. Easterday, the United States Court of Appeals for the 9th Circuit affirmed a conviction of 30-month sentence for Mr. Easterday’s failure to pay withheld payroll taxes to the Internal Revenue Service.
